Cutting Edge Tree Surgery (Us) & the Client (You) both agree that the terms & conditions below have been read in full & are understood. By accepting our quote either verbally, in writing or by signing the attached quote the customer agree’s to all terms & conditions set below. If the customer has any concerns regarding any part of our terms & conditions or scope of works provided in the quote the customer must contact us prior to accepting to discuss options.

Our Guarantee 

Cutting Edge Tree Surgery guarantee to supply the services offered in the written quotation supplied in accordance to our terms & conditions listed within this document unless otherwise specified within the quote. We will do our best to ensure you are satisfied with all works performed. We are fully insured for public liability and are happy to provide a copy of our insurance certificate upon request. 

Customers Responsibility

1. By agreeing to our quotation you are giving us authority to access the premises to perform works at the times/days organised with you. The worksite must be accessible for staff, trucks & machinery to have clear access to enter the property & work area/s. If entry to the property, premises is not accessible or we are denied access on the day of works the customer may be charged additional fee’s set out below for any delays that may occur whilst awaiting on accessibility. 

2. For our safety & your pets please ensure all animals are locked away so that we may access the property & perform our works required. Failure to do so may result in us being unable to perform the works on the day and may also result in delays or additional fee’s being charged.

3. Any moveable items/objects that we have asked be moved prior to allow safe access & limit damage must be cleared. We will not hold any liability for items/objects that have not been moved prior, and additional charges may be applied if we have to move them. 

4. The customer agrees to comply with any directions given by us to undertake the required works. All onlookers within the property must remain at a safe distance designated by us from the work site. At no time are customers or onlookers to be within the designated work area. Additional charges may apply in the event that work is required to stop or be delayed due to anyone failing to follow our directions to stay out of the work area. This includes if someone enters the worksite for any reason beyond our control.  

5. The customer agrees that all trees & stumps listed in the quotation are owned by the customer or they have authority on the owners behalf to have the said trees or stumps pruned/removed. The customer agrees that they have received permission from neighbours to work on any tree’s/ stumps contained on property lines with adjoining properties. The customer agrees that they have received all authority, permissions & property checks through local authorities & councils to ensure the trees covered in the quotation are approved for pruning or removal as discussed. If required you must provide us with a copy of any approvals required. You agree to indemnify us against any claim, liability, damages or costs incurred by us due to failure to hold necessary consent, permission or approval or as a result of any dispute associated with the authority given to us to remove or deal with any tree.  

6. The customer warrants that the work area or site is free from any hazards which may cause harm to workers or machinery to the best of their knowledge.

7. The customer agrees that the works outlined within the quotation are approved, and any further works required may incur additional expenses which will be discussed if required prior to additional works taking place. 

8. The customer agree’s to pay the amount written on the quotation in full by the due date written on the quote unless discussed prior. Failure to do so may incur additional charges or fee’s which will be set out below.

9. Any fences or gates that require removal to gain access to the property or work area will be discussed prior to works starting. Failure to agree on removal of fence panels or gates to gain access may result in those described works not being able to be performed as discussed.

10. If we have notified you that we will required access to your neighbours property in order for us to complete the works required, it is your responsibility to notify them & obtain permission for us to access their property. Failure to do so or failure for us to be able to enter their property on the day may result in works not being able to be completed.

Quotations

Quotations are valid for 30 days from the date shown on the quote unless otherwise stated by us. Any alterations to the original quote requested by the customer may require a new quote & delays in undertaking the works. No changes can be made to this quote once accepted, any additional works required at the time will be charged separately. In the case were the customer would like to proceed with a quote after 30 days a new quote will need to be drawn. In some cases we may need to re visit the property/site in order to draw up a new quote. In this case a fee of $100 may be charged.

Bookings

Bookings will be scheduled as soon as possible & we will do our best to ensure we can provide a date & time suitable for both us & the customer. In some cases jobs will be booked along with other jobs in the area to minimise travel or additional costs in machinery hire which will be reflected in your quoted price. In the event of factors out of our control such as cancellations, weather etc we may need to reschedule your job. We will always do our best to provide as much notice as possible & accommodate specific date or time requests, however this may not always be possible especially in the event of unprecedented weather events. In some cases jobs may need to be canceled on the same day they are to occur, although we try our best to keep this as minimal as possible. 

Cancellation, Site Access Failure & Stop Work Fee’s

1. We require you to provide at least 24hrs notice prior to scheduled works of any full or partial work cancellation for jobs that have been booked. Your request must be acknowledged & accepted by us. In the event that a crew has been dispatched to your job site due to us not being informed, or you failed to give us 24hrs notice a minimum fee of $150 will apply to jobs not requiring heavy machinery or $650 for jobs requiring booking of heavy machinery to perform works. 

2. We require suitable access to be provided on the day of works, failure to be able to access the property/site may incur a fee of up to $1000 or the price of the job if less than $1000.

3. In the event that work must stop for a period of time due to events outside our control such as onlookers within the work area creating a safety hazard, authorities requiring a stop work or other circumstances outside our control a fee of $200 per hour will be applied. 

Equipment Access

All prices quoted assume our truck & machinery equipment will have access to the property where required or as discussed during our visit or quote. This may include having to drive trucks or heavy machinery on concreted, tiled or paved areas as well as lawns/grass which may result in lawn indentation, grass being damaged, track/tire marks, concreted, tiled or paved areas being damaged or cracked. Smaller machinery may require access up to or on garden beds, stairs etc. During periods of prolonged wet weather or rain on the day of works damage to lawns, grass & substrate can be more than usual. In some cases especially in areas that are poor drainage equipment may get bogged & require retrieval which may cause additional damage. We will always explain during our visit what will be required to complete the works set out in our quote, in the event that heavy machinery is being used we will explain what damage may occur. In the event there has been prolonged rain prior to our works starting we will contact the customer to give them the option to proceed on the scheduled day or reschedule for a more suitable time. if this is unacceptable we must know prior to acceptance of the quotation. The customer agrees they accept these conditions when accepting our quote. As always we will take all possible care to minimise any damage to the surrounding area caused by machinery & works, however we accept no liability for damage to walk ways, turf, concreted, tiled, paved or any surfaces of any work areas that may be damaged. We also accept no liability for damages incurred to subterranean structures or underground services including sprinklers that we are unaware of prior to access. 

Heavy Machinery

Heaving Machinery includes equipment such as trucks, chippers, EWP’s, cranes, excavators, loaders, stump grinders, vehicles or any equipment weighing more than 500kg. Equipment required will be discussed on our visit or mentioned within your quote.   

Stump Grinding Services

1. Unless stated otherwise stump grinding will include grinding the visible stump & roots (within a 1m radius) up to a depth of 300mm below the ground surface. If the stump is required to be ground deeper or roots are required to be chased further than this must be made aware during our quoting process & made notable on the quote. Additional charges will occur.

2. It is the customers responsibility to make sure there is clear access for the stump grinder to be able to gain access to the stump. This includes moving any items, objects or valuables that may be in the immediate way or be at risk of being damaged due to flying debris from the grinding process. We will not be held responsible for such items being damaged if they are in the immediate area. Any issues regarding moving such items should be discussed with us prior to works starting. 

3. It is the customers responsibility to obtain all necessary property searches & reports to ensure there are no underground services in the immediate area were stump grinding works are to take place. In some cases we may require a copy of these reports in order for work to proceed. Customer’s must disclose to us prior to works commencing of any underground services such as electrical, water or cable services that may be impacted. We do not hold any responsibility for damages that may occur to such services we have not been made aware of. If such services do exist in the immediate area that we have been made aware of we will put a note in the quote. Otherwise it is to be taken as no services exist in the area. 

4. The stump hole will be backfilled with remaining wood chip left onsite (unless otherwise stated on quote). Removal of wood chip offsite is not included (unless otherwise stated in quote).

5. The customer acknowledges that there is no known foreign objects underground that may cause damage to our stump grinding machine, such as large buried metal items, concrete, bricks or large rocks or the likes. In the event that we should hit such an item causing major damage to the grinders cutting teeth an additional fee for teeth replacement may be charged in some circumstances. Areas that have known items underground must be made aware to us prior to quoting so we can adjust the quote to suit and assess the risks involved. 

Tree Services

1. We will complete the removal of any tree as close to ground level as possible without causing damage to our equipment as long as it is safe to do so. Additional charges may be incurred for any unforeseen metal or concrete found in the tree that may cause damage to our equipment upon notification to you. 

2. During tree removal some damage may occur to surfaces such as gardens, lawns or surrounding items such as garden beds, garden edging, pavers or pathways due to falling trees, branches, limbs, leaves, dust, seeds/pods. Some indentation in the lawns surface may also occur for large tree’s being felled as a whole.  Whilst relocating logs, limbs and debris from the site to our machinery there may also be scuff marks, drag marks, soil, friction marks or surface indentations from machinery. All care is taken in felling & moving debris, however we will not be held responsible for such damage due to the nature of the works unless it is due to our intentional negligence. If we have any concerns we will let you know during the quoting process, if you have any concerns with this please notify us prior to works taking place.

3. Please ensure on the day of works beginning that the immediate area is clear of any moveable items, objects or valuables that could potentially be damaged by falling debris, trees or equipment.  If you are unable to move an item that is potentially in harms way please inform us prior to work starting so we can make alternative arrangements. We will not be held responsible for any damages that could occur to items that we have asked to be moved or could have been removed from the immediate area to avoid damage.

4. Clean up will include removal of logs, branches, leaves & twigs unless otherwise stated in your quote or the job is a drop & leave. The work area will be raked to clear debris from the tree’s worked on, this does not include other leaves or debris in the area that are not part of the job being performed. 

Payment

1. Payment is due on the day of works being completed or within 5 business days of receiving your invoice, unless prior arrangements have been made. Payment can be made as cash on the day or via bank transfer once you receive your invoice. When paying via bank transfer please make sure to use your invoice number as your reference & email us a copy of your transfer receipt. 

2. Customers failing to make payment on time may incur an interest charge of up to 10% of the total invoice amount for every month that the invoice is overdue. Any accounts not paid within 30 days from the date of invoice will be passed over to a collection agency & further fees will incur. You hereby agree to indemnify us against any such additional costs incurred. You also agree to pay on default all costs & expenses incurred in exercising our rights of recovery from you and indemnify us against any losses resulting from the default.
